In order to practically strengthen the incorruption management of construction project, put an end to corruption at its source, recently, Comprehensive Bonded Zone of Xiangtan has issued the following regulation: When signing project contract with the contractor, the new construction projects within the whole zone that use the funds inside and outside the financial budgets at various levels, government financing and other funds to implement the fundamental construction, and are surveyed, designed, constructed and supervised by domestic enterprises and purchasing from domestic enterprises must simultaneously sign the Contract for Incorruption in Construction Project of Comprehensive Bonded Zone of Xiangtan (hereinafter referred to as the Contract for Incorruption in Construction Project).
Subject to the Notice on the in-depth implementation of anti-corruption and anti-unfair competition in project construction of the Ministry of Construction of the People's Republic of China and the Ministry of Supervision of the People's Republic of China, and the Implementation opinions on further promoting the reform and development of construction industry of Xiangtan Municipal People’s Government (TZF [2015] No. 2), Law against Unfair Competition, Construction Law, Law on Tenders and Bids and the regulations on project construction and incorruption construction, according to the actual situations of Comprehensive Bonded Zone of Xiangtan, the Contract for Incorruption in Construction Project clearly stipulates the responsibilities and obligations of both parties. For example, Party A and Party B shall abide by the provisions of the state, Hunan Province, Xiangtan City and the industry competent departments on incorruption construction; strictly implement construction project contractual documents and consciously handle affairs according to contract. Unless otherwise specified in the legally recognized business secrets and contractual documents, business activities of Party A and Party B should adhere to the principles of openness, fairness and transparency, unfair trading that harms the national and collective interests and violates construction project management rules and regulations, etc. shall be strictly prohibited.
In order to ensure the implementation of the Contract for Incorruption in Construction Project, both parties shall respectively report to the disciplinary inspection department of Comprehensive Bonded Zone of Xiangtan in the middle period of the construction contract (for the projects with the construction period more than six months). Disciplinary inspection department and relevant departments will, depending on the situations, come to the construction site to regularly or irregularly check the implementation of the Contract for Incorruption in Construction Project through questionnaire survey and publicizing informants' hot-line telephone, etc. Those violating the contract provisions shall be investigated for responsibility according to the administrative authority.
Contract for Incorruption in Construction Project is an innovative measure of Comprehensive Bonded Zone of Xiangtan to strengthen the risk prevention and control system in key areas and the risk prevention and control system for incorruption in construction, which will play a positive role in preventing corruption in construction and ensuring the cadres and staff to be uncorrupted. Recently, Xiangtan Comprehensive Bonded Zone Construction Investment Co., Ltd. has signed the first incorruption contract in the Comprehensive Bonded Zone of Xiangtan with Xiangtan Ya’ai Construction Engineering Co., Ltd.
